Welcome to the Terms and Conditions for Beyond Bounds Adventure. These terms outline the essential information about our policies, including booking procedures, payment requirements, cancellation policies, and participant responsibilities. By choosing to embark on an adventure with us, you acknowledge and agree to these guidelines, ensuring a safe, enjoyable, and organized experience for all participants. We are committed to transparency and providing you with clear expectations for your journey. Please review these terms thoroughly, as they serve to protect both our customers and our company, fostering a responsible, respectful, and memorable adventure for everyone involved.
Reservation
You must be at least 18 years of age to make a booking and provide full, complete, and accurate information. Your name must be exactly the same as on your passport. We are not liable for any errors or omissions in the information provided to complete a booking. By booking on behalf of other participants, you are deemed the designated contact person for every participant included in that booking. This means you are responsible for making all payments, notifying the Tour Operator or travel agent of any changes or cancellations, and keeping your party informed. You represent and warrant that you have obtained all required consents from other participants. You are responsible for verifying that the information provided on behalf of another participant is complete and accurate. The Tour Operator is not liable for any errors or omissions in the information provided.
You will receive a confirmation email after receipt of the applicable deposit amount. Please check your confirmation carefully and report any incorrect or incomplete information immediately. We reserve the right to cancel or change the date of services for any reason.
Payment
At the time of booking a non-refundable deposit is due to the Tour Operator. If the booking is made 60 days or less prior to departure, full payment is due at the time of booking.
The confirmation email will contain details of the final payment required for any booking. Payment of the balance for any products or services booked (excluding Expeditions) is due 60 days before the departure date. For Expedition trips, full payment is due 120 days before departure. If full payment is not received by the due date, the Tour Operator may change the rate payable or treat the booking as canceled, retaining the deposit as a cancellation fee. If a deposit option available, for bookings made less than 60 days before departure, full payment is required within 48 hours of booking confirmation. Failure to pay by the specified due date will result in cancellation and forfeiture of any funds paid. If payment terms differ from those outlined, the applicable terms will be communicated prior to booking and detailed on the invoice.
Cancellation Policy
Due to the advance work, preparation, and reservation of tickets, permits, and other arrangements, our trips are non-refundable. However, if a booking is canceled 121 days or more prior to the scheduled departure date, the deposit (less a applicable booking modification fee) may be held as a credit towards a future trip. Applicable booking modification fee is $50.
We strive to operate all scheduled products as planned, except in situations of Force Majeure. In the event that we must cancel a product tour before the commencement date due to Force Majeure, insufficient participant numbers, or circumstances within our reasonable control, you will be given the following options:
We are not liable for any incidental expenses or consequential losses that you may incur due to the canceled booking. If your trip is cut short for reasons beyond our control, no refund or compensation will be provided for any unused services or features of the trip. Specifically, we will not offer compensation if your travel arrangements are canceled or changed due to Force Majeure. You will be responsible for any additional costs incurred, including additional hotel accommodation or changes to flights.
While the Company endeavors to maintain the trip as advertised, unforeseen circumstances beyond its control may require changes to the itinerary, substitution of accommodations, or alterations to specific advertised activities. The Company reserves the right to make such decisions at its sole discretion and is not responsible for any expenses or losses resulting from these changes.
Medical Conditions
By booking the tour, you acknowledge that you are physically and mentally healthy and able to participate in the trip. You are responsible for assessing whether a Tour is suitable for you and should consult your physician to confirm your fitness for travel and participation in any planned activities. The Tour Operator does not provide medical advice. It is your responsibility to assess the risks and requirements of each aspect of the Tour based on your own unique circumstances, limitations, fitness level, and medical requirements. You must inform the Tour Operator of any health and safety issues related to yourself or anyone for whom you reserve the tour. If you have an existing medical condition or disability that might affect your trip, you must inform us.
The Tour Operator may require participants in Adventure Trips or Expeditions to complete a medical form before the trip. If you indicate any pre-existing medical conditions on the Medical Form, the Tour Operator may require further medical information and/or assurance. You must provide a medical certificate, duly completed and signed by a licensed, competent, and practicing physician, upon request.
Pregnancy is considered a medical condition and must be disclosed at the time of booking. The Tour Operator may refuse to carry women who are over 24 weeks pregnant or anyone with certain medical conditions if reasonable accommodation or alternatives cannot be arranged. If you do not complete the required Medical Form or provide the necessary medical information by the deadline, the Tour Operator reserves the right to cancel your booking and apply cancellation fees.
In the event of an emergency, you consent to the administration of first aid by the guide to you and any minors traveling with you. You fully release, indemnify, and hold harmless the Company from any and all claims or actions for damages that may arise from any first aid, treatment, or administration of medication provided during a medical emergency involving you or any minors traveling with you.
Participants acknowledge the risk of exposure to highly transmissible diseases, which may be transmitted through personal contact. You agree to follow all health and safety protocols and policies implemented by the Company, as well as any applicable laws, regulations, and mandates enforced by local or national authorities. You accept the risks associated with traveling to areas where there may be a heightened risk of contracting or being exposed to transmissible diseases. By participating, you waive any claims against the Company and release the Company, its employees, officers, directors, and agents from liability for any claims arising from your travel related to such diseases, including infection, transmission, or risk thereof. Additionally, if you provide false information to the Company, you waive any claims related to harm or damages resulting from such information and agree to indemnify and release the Company from any related claims. You also waive any claims related to harm or damages resulting from failure to comply with health and safety policies and agree to indemnify and release the Company from any related claims.
Physical and Mental Condition
By booking the tour, you acknowledge that you are physically and mentally healthy and able to participate in the trip. Many expeditions involve high-altitude or remote locations, long-distance walking, hiking, or climbing. By reserving these types of tours, you agree that your physical and mental condition is suitable. The Tour Operator is not responsible for any incidents, injuries, death, or expenses due to your lack of physical and mental abilities. Your booking is accepted on the understanding that you accept the risks and hazards involved in adventure trips. The tour operator reserves the right to deny you permission to travel or participate in any aspect of a Tour at any time if they determine that your physical or mental condition renders you unfit for travel or represents a danger to yourself or others.
Risks
Participation in our nature tours involves inherent risks, including exposure to natural elements, wildlife encounters, insect bites, animal attacks, and challenging terrain. While every effort is made to ensure safety, customers acknowledge and accept these risks. Participants must adhere to safety guidelines provided by the tour guides and act with caution and respect for the natural environment. By booking a tour, participants agree to assume all associated risks and release the company from any liability for injuries, losses, or damages during the tour.
Expeditions to high-altitude or remote locations carry an inherent risk of altitude illness. Most trips visit remote locations with limited infrastructure, increasing health risks and reducing the ability to treat injuries or illnesses effectively. By booking the tour and embarking on your trip, you acknowledge these hazards and accept the associated risks.
Behavioral Considerations
Participants must adhere to the following guidelines to ensure a safe and enjoyable experience:
We value and celebrate diversity and maintain a zero-tolerance policy for discrimination. All participants must respect others, regardless of background, race, religion, age, sex, and political opinions. The Tour Operator reserves the right to remove any participant from the tour who does not respect these guidelines. The Tour Operator is not responsible for any losses or expenses incurred due to the decision to remove a participant from the group because of inappropriate behavior. By booking a tour, participants agree to abide by these behavioral considerations, ensuring a respectful, safe, and enjoyable experience for everyone involved.
Equipment
The Company may provide equipment for your use. While the Company checks this equipment before each tour, you are responsible for inspecting the equipment upon receipt and reporting any issues to the guides. You acknowledge that you are in exclusive control of the equipment once it is provided and agree to adhere to the gear recommendations provided by the guides throughout the trip and during all activities.
Travel Insurance Requirement
Comprehensive travel insurance is strongly recommended and mandatory for some trips (including but not limited to the Himalayas, Africa and Latin and South America) to cover medical, evacuation, and repatriation expenses coverage of $200,000. The cost of the tours does not include insurance. This insurance must encompass all activities and destinations of the trip, including high altitudes as specified in the itinerary. Participants are responsible for any costs incurred during emergency medical rescues or evacuations, as well as additional expenses such as accommodation and transport. Proof of adequate insurance must be provided prior to departure; failure to do so may result in the cancellation of the booking without refund. It is also strongly recommended to have coverage for trip cancellation, flight issues, loss of luggage, and personal effects. Images And Marketing
The Participant agrees and acknowledges that, while participating in any tour or activity provided by us, images, photos, or videos (collectively “Images”) may be captured by other participants, our representatives, or the Lead Guide, which may include the Participant in part or whole. The Participant hereby consents to the capture of such Images and grants a perpetual, royalty-free, worldwide, irrevocable license to us, our affiliates, contractors, sub-contractors, and assigns, to reproduce, use, and distribute these Images for any purpose whatsoever, including but not limited to marketing and promotional activities. This license extends to all media formats, whether currently existing or developed in the future, without any further obligation or compensation to the Participant. The Participant agrees that the use of these Images by us or our affiliates will be without charge and may include use in brochures, websites, slideshows, video presentations, and online platforms
